Welcome to Loksar. These Terms and Conditions ("Terms") govern your access to and use of the Loksar platform, including our website, applications, APIs, and related services (collectively, the "Services"), operated by Loksar Ltd ("Loksar", "we", "us", or "our").

Loksar is a platform that helps individuals exercise their legal data access rights. We facilitate the submission of Subject Access Requests ("SARs") and similar data portability requests to third-party companies on your behalf, collect the data they return, and make it available to you in one centralised location.

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Services.

2. Eligibility

You must be at least 18 years of age to use the Services. By using the platform, you confirm that you meet this requirement and are legally entitled to submit SARs or equivalent data access requests in your jurisdiction.

If you use the Services on behalf of another individual or legal entity, you represent that you have their authorisation to do so and to bind them to these Terms.

3. How the Services Work

Loksar acts as a facilitator between you and third-party data controllers. When you instruct us to do so, we submit data access requests to companies on your behalf, using only the information you have provided and authorised us to use.

We do not control, alter, or guarantee the content, completeness, or accuracy of any data returned by third-party companies. The data you receive depends entirely on how each company chooses to respond to your request and the nature of your relationship with them.

Once collected, your data is stored securely in your Loksar account and made available to you through our platform and APIs. You may use this data to build custom tools or integrations as you see fit.

4. Your Responsibilities

You are responsible for ensuring that any requests submitted through our platform are lawful and relate to data that you are entitled to access. Submitting requests on behalf of another person without their knowledge or consent is a violation of these Terms.

You agree not to use the Services to:

  • Submit requests you are not legally entitled to make
  • Harass, abuse, or unduly burden third-party data controllers
  • Access or attempt to access data belonging to others without authorisation
  • Reverse engineer, scrape, or interfere with the platform or its infrastructure
  • Violate any applicable law or regulation

5. User Accounts

To use most features of the platform, you will need to create an account. You agree to provide accurate and up-to-date information during registration and to keep your account credentials secure and confidential.

You are responsible for all activity carried out through your account. If you believe your account has been compromised, you must notify us immediately at support@loksar.com.

6. Data Protection and Privacy

Your personal data and any data collected from third parties on your behalf remains yours at all times. Loksar acts as a data processor with respect to that data and handles it in accordance with our Privacy Policy.

We do not sell, share, or use your data for advertising or profiling purposes. Data is stored securely and is accessible only to you, unless you explicitly authorise otherwise.

7. No Legal Advice

The Services are provided for administrative facilitation purposes only. Nothing on the platform constitutes legal, regulatory, or professional advice.

8. Relationship with Third-Party Companies

Loksar has no formal agreement or partnership with the third-party companies to which we submit requests on your behalf. Each company is an independent data controller and is solely responsible for complying with their own data protection obligations.

We cannot guarantee that any request will be fulfilled, acknowledged, or completed within a specific timeframe. If a company does not respond or disputes your request, we will keep you informed, but resolution is ultimately between you and that company.

9. Fees and Payments

Some features of the platform may be subject to fees. Any applicable charges will be clearly disclosed before you are asked to pay. Fees are non-refundable except where required by applicable law.

10. Intellectual Property

The Loksar platform, including its software, design, branding, and tools, is the property of Loksar Ltd or its licensors. You may not copy, modify, or distribute any part of the platform without our prior written permission.

You retain full ownership of your personal data and any outputs or tools you build using data stored on the platform.

11. Suspension and Termination

We reserve the right to suspend or terminate your access to the Services if you breach these Terms, if your use of the platform creates legal or security risk, or where required by law. We will endeavour to notify you before taking such action where practicable.

Upon termination, your right to use the Services ceases immediately. You may request a copy of your data prior to account closure in accordance with our Privacy Policy.

12. Limitation of Liability

To the maximum extent permitted by law, Loksar shall not be liable for any indirect, incidental, or consequential losses arising from your use of the Services, including but not limited to losses arising from the actions or inactions of third-party data controllers.

Our total liability to you shall not exceed the total fees paid by you to Loksar in the twelve months prior to the event giving rise to the claim.

13. Governing Law

These Terms are governed by and shall be construed in accordance with the laws of England and Wales. In the event of any dispute, you and Loksar agree to first attempt to resolve the matter in good faith before pursuing any formal proceedings.

14. Changes to These Terms

We may update these Terms from time to time. If we make any material changes, we will make reasonable efforts to notify you. Continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.
